In “Pre-Conventions. A Fragment of the Background”, Celano argues that there are ways of acting that can be called “conventions” which are, literally, normative facts. There are a number of interesting claims in Celano’s paper about the nature of these conventions, and showing that they amount to normative facts is only part of his strategy for establishing their significance. But given that the question of whether there are normative facts deserves a treatment of its own, the paper inquires whether Celano’s (...) account of normative facts is plausible. It then makes three claims. First, it claims that Celano’s account of normative facts is in need of clarification. Amongst other reasons, there is no proper characterisation of either the concept of fact or of the concept of norm. Second, the paper claims that, under a relatively acceptable way of understanding facts and norms, Celano’s argument in favour of normative facts needs to be completed. But if the argument is completed by appealing to the general philosophical outlook which Celano seems inclined to employ, the argument reaches a point where it becomes unstable. This does not, of course, mean that the project should be abandoned. An argument within the same line of thought may be available. But the prospect seems uninviting. So, thirdly, the paper proposes a sketch of an alternative, Kantian-like conception of normative facts based on an argument put forward by Christine Korsgaard. (shrink)

We ascribe the performance of intentional actions to groups. We claim, for instance, that the orchestra is playing a symphony, that a gang has robbed a bank, and so on. But what is a collective intentional action? Most accounts suggest that, for there to be a collective intentional action, at least two necessary conditions should be met. First, participants must act in accordance with, and because of, the intentions that the group perform a certain action. Second, there must be common (...) knowledge. These accounts, however, face two difficulties. On the one hand, they are uninformatively circular, for they employ in the analysis the very notion of group-action that they are trying to elucidate. On the other hand, they are too demanding, for there are cases of collective intentional action where neither of the conditions is met. The article proposes, by developing further an account put forward by Christopher Kutz, a model of collective intentional actions that overcomes these two problems. Yitzhak Benbaji argues that those combatants who have agreed to blindly obey their superiors and who are ordered to fight in unjust wars are released from their duty to deliberate about the merits of the acts that they are ordered to perform. This is because their agreements result in the combatants’ permissible lack of a necessary capacity for moral responsibility. Thus, the combatants are not morally responsible for their wrongful acts—their moral responsibility is “transferred” to their superiors. We argue, first, (...) that Benbaji’s own reasoning suggests that the agreements entered into between the combatants and their superiors are not binding and, second, that even if such agreements are binding, those combatants who obey their orders to fight are nevertheless morally responsible for their wrongful acts. Thus, Benbaji has failed to show that the combatants are permitted to act as ordered. By critically examining Benbaji’s view, then, we defend the revisionist position that just and unjust combatants are morally unequal. (shrink)

David Estlund and Massimo Renzo argue that, given the right background conditions, combatants are obligated to obey orders to fight in unjust wars, a thesis they put forward even as they recognize that this involves committing serious moral wrongs. Their views, then, fall between traditionalism and revisionism in the theory of just war. We argue that both Estlund and Renzo fail to adequately distinguish between binding and nonbinding serious morally wrong orders, that their views are incompatible with their assumed fact‐relative (...) understanding of morality, and that they fail to establish that combatants are obligated to obey orders to fight in unjust wars. Adult learners demand teaching innovations that are ever more rapid and attractive. As a response to these demands and the challenges of skills training, this article presents a conceptual analysis that introduces competitive debate as an impact training model. The aim is to learn whether debate can be considered to fall within the frame of gamification, so that the full potential of debate as gamification can be exploited. There is a significant research gap regarding competitive debate as a game, with (...) the training mechanics for adult learners remaining practically unexplored. ABSTRACT The objective of this study was to determine the accuracy of a brief informed consent quiz to detect consent comprehension in individuals with cognitive impairment and to explore the degree to which cognitive domains and recent substance use, independently, predict comprehension. We performed a secondary analysis of two cross-sectional studies in individuals with substance use disorders. The ICQ total score was used as the index test and the Montreal Cognitive Assessment as reference standard in receiver operating characteristic curves. Two (...) independent multiple binary logistic regression models were performed using cognitive domains and days of recent substance use as predictors of ICQ outcome. We analyzed data from 215 and 251 participants, respectively. The ICQ showed moderate accuracy for major cognitive impairment and lower accuracy for mild impairment. Optimal cutoff score was set at 10 points or less for detecting comprehension difficulty. Lower scores in Short-Term Memory, Attention, Language, and Orientation increased the probability of failing the ICQ. A procedure including both the ICQ and cognitive screening measure could improve the accuracy of consent comprehension assessments. (shrink)

Situados en un progresivo traspaso de responsabilidades en la ejecución de los servicios sociales desde el Estado hacia actores no gubernamentales, aparece una demanda hacia el mismo Estado, el cual en lugar de simplemente declinar su labor, debiera de hecho expandir su regulación de modo de asegurar que la oferta social sea eficiente en satisfacer al ciudadano usuario en aquellos servicios prometidos por las políticas y programas sociales. Así mismo, la institucionalidad pública debiera reconocer las demandas del mundo privado para (...) actuar articuladamente hacia fines comunes, que finalmente conduzcan a un horizonte de desarrollo de una sociedad más igualitaria. El presente artículo da cuenta de una instancia de trabajo colectivo con profesores y profesoras de aula, el “Taller de Educadores Autores” (TEA), que tiene como propósito rastrear el proceso de construcción de nuevas subjetividades docentes que permitan dar cuenta de las actuales condiciones en que es desempeñada la docencia, así como proponer otras formas de ser docente. A través del Taller, los profesores y profesoras problematizan acerca de los significados y sentidos de su trabajo por medio de la escritura (...) de relatos de experiencias. En primer lugar, se situará el proceso de trabajo y subjetividad docente en el Chile actual. Luego, se explicitarán algunos aspectos fundamentales de los procedimientos y la metodología que orientó el proceso colectivo de indagación del TEA. This study analyses the emotional exhaustion of students inhigher education, derived from the extremely technology-relatedstrain associated to the current COVID-19 pandemic in a conservation of resources’ approach. Technostress, as source of emotional exhaustion, was investigated in a sample of 333 students in a medium size public university in Spain. Data was collected in May 2020, during the COVID lockdown. After literature review, a structural model was developed, linking technostress with emotional exhaustion. Results confirm the expected cause-effect relationships. In addition, the (...) study reveals two mediator variables that must be considered when managing students′ suffering, perceived stress and intrapersonal conflicts. This study contributes to the academic literature in the field of managing and mitigating suffering. University students will be our future business leaders, and will have to address social problems caused by business by implementing solutions such as social entrepreneurship ventures. In order to facilitate the learning process that will foster social entrepreneurship, however, a more holistic pedagogy is needed. Based on learning theory, we propose that students’ social entrepreneurship actions will depend on their learning about CSR and their absorptive capacity. We propose that instructors and higher education institutions can enhance this absorptive capacity by (...) exploiting Web 2.0 technologies. El objetivo del siguiente artículo es observar los rendimientos de la hermenéutica filosófica para interpretar el problema de la confianza en nuestras relaciones sociales. En primer lugar, se identifican sus fundamentos para comprender a través de esta tradición filosófica su giro lingüístico e importancia para estudiar dicho concepto ; en segundo lugar, se analiza desde la idea del ‘lenguaje’ y del ‘diálogo’ el problema de la confianza en las relaciones contextuales. Por último, se reflexiona sobre cómo la racionalidad científica proyecta (...) confianza o desconfianza en un mundo en donde cada vez sus enunciados deben comprometerse con la vida humana. Este artículo es relevante pues busca revalorizar a la filosofía para el análisis de un concepto que ha sido estudiado principalmente desde las ciencias sociales. En este sentido nos apoyamos en la hermenéutica filosófica en pos de observar sus posibilidades para conceptualizar y analizar la confianza en la sociedad contemporánea. (shrink)

Since the late nineteenth century, studies of Ammianus’ audience have reached widely divergent conclusions. Research has focused on two opposed theses: while some scholars have seen the pagan senatorial aristocracy as the audience of the Res Gestae, others have assigned that role to the imperial bureaucracy. However, in thinking that a work could reach—or target—exclusively the members of a specific social group, the prevalent views on Ammianus’ audience contradict what we know about the circulation of books in the late Roman (...) world. In contrast to previous research, this study proposes a new approach based on an analysis of the information available on book circulation in Ammianus’ time. This analysis shows that the audience of the Res Gestae was most likely socially diverse. (shrink)

The Coalition of Immokalee Workers (CIW) has successfully combated modern-day slavery by transforming the ways that over a dozen major brands, including Taco Bell, Subway, and Wal-Mart, manage their supply chains. The CIW’s efforts over more than 20 years have effectively stopped enslavement practices, including abuses such as wage theft and peonage indebtedness. We conducted a field ethnography, interviews, and archival analyses to understand this success. We find that the CIW employs a decentered, egalitarian, and ensemble approach to their multiplicities (...) of alliances by collectively “animating” themselves and their partners through ensemble leadership. This combination of alliances, along with worker-driven monitoring, brings life to the CIW motto “We are all leaders.” Translating this motto into daily practice is how the CIW virtually eradicates enslavement practices in corporate supply chains. Este trabajo tiene por objeto el estudio del bien jurídico de la libre competencia en el mercado como posible bien jurídico digno de tutela penal. Al respecto se plantean dos problemas esenciales: el propio concepto de competencia y el respeto a los principios legitimadores del Derecho penal. Para no argumentar en abstracto, se analiza un problema político-criminal concreto: el delito de corrupción entre particulares como delito contra la competencia en el mercado. La cuestión del significado de la entonación, ya sea como fenómeno de la lengua o del discurso, ha sido uno de los aspectos más debatidos en las últimas décadas. Este trabajo se propone estudiar el valor comunicativo de los patrones de entonación del español de Cuba con un enfoque basado en la Teoría de la Complejidad; lo cual permite interpretar las dimensiones ilocutiva y modal de los actos de habla interaccionales a partir de la confluencia de la prosodia con el (...) resto de los medios de expresión de la lengua y los factores contextuales. Se parte del análisis empírico de una muestra de enunciados/actos de habla del discurso académico oral, al cual se aplican métodos perceptivos, acústicos y semántico-pragmáticos, partiendo de la relación sistema-discurso como principio teórico-metodológico. El estudio realizado demuestra el empleo de 6 tipos diferentes de patrones de entonación, codificados en el español de Cuba, que mantienen cierta estabilidad en sus rasgos prosódicos fundamentales, aunque evidencian una variabilidad en sus funciones semántico-pragmáticas. Perú es uno de los destinos turísticos internacionales más reconocidos de Sudamérica. Buena parte de este desarrollo ha venido de la mano de la diversidad de su patrimonio cultural y natural, en el sentido más extenso de ambos. No obstante, la evolución turística del país ha estado condicionada por una historia política convulsa, especialmente durante el siglo XX. Los contextos socioeconómicos nacionales e internacionales han condicionado la potencialidad del fenómeno en el país, así como también el irregular apoyo y papel (...) del Estado peruano. En este sentido, este articulo revisa, desde un enfoque historiográfico, la relación entre la política y el turismo peruano, incidiendo en la segunda mitad del siglo XX, en la cual el boom turístico internacional coincide con los gobiernos civiles y militares de la década de los años 60-70, el auge de la violencia en los años 80 y el ascenso del fujimorismo de los 90. Todo ello, para explicar la propia inestabilidad de un sector en constante crecimiento desde el año 2000. (shrink)

El proyecto educativo Auschwitz: El escenario del horror se desarrolla entre 2017 y 2019, desde su gestación hasta las exposiciones de fotografías y charlas-coloquio en el que se ha enmarcado. Forma parte de una enseñanza informal, en el que los aprendizajes están determinados por situaciones cotidianas del contacto social, que no está organizado o administrado por una estrategia educativa determinada. Es una experiencia que se desarrolla en ámbitos relajados, como en el caso de asociaciones culturales o ayuntamientos. El autor de (...) las fotografías desempeña el símbolo de la mirada del visitante, que, a través de su cámara, nos enseña el campo de muerte de Auschwitz, describiéndonos los sentimientos y las sensaciones que allí pudieron acontecer en los primeros años de la década de los 40. We ordinarily use epistemic concepts to evaluate our moral views. We know certain things are wrong, we are sometimes uncertain about the morally best thing to do, we think there are rational and irrational ways of reaching moral conclusions, etc. Like most meta ethicists, expressivists aim to explain this; they want to offer accounts of our moral thought, talk, and practice. However, most expressivists think moral thought and talk are fundamentally non-representational or desire-like. Critics have argued that this makes the (...) view incompatible with central aspects of our epistemic evaluations. In this paper, I survey the main epistemic challenges for expressivism, highlight their interconnections, and discuss the most promising responses. (shrink)

Franciscus Sanchez ist profunder Kenner der erkenntnistheoretischen Auseinandersetzungen seiner Zeit. Sein konsistentes skeptisches Denken und der hohe Grad der Argumentativität seiner Ausführungen machen Sanchez zu einem herausragenden Vertreter des frühneuzeitlichen Skeptizismus.

Resumen: Este artículo busca observar las diferencias entre el modelo sistémico funcional y el modelo pragmático-formal en su comprensión de la experticia científica y su rol en las sociedades modernas. Se elaborará un breve diagnóstico acerca de la importancia de la confianza en experticia científica en la sociedad contemporánea y cómo este proceso ha sido analizado. Luego, se analizará la descripción del conocimiento científico en la sociedad contemporánea desde el modelo sistémico funcional. Utilizando los conceptos de diferenciación funcional y acoplamiento (...) estructural, se sugerirá que, desde este modelo, el conocimiento científico es una forma de comunicación especializada propia de un sistema funcional de la sociedad. A continuación, se describirá la aproximación del modelo pragmático formal. Especial importancia tienen aquí las ideas de mundo de la vida y esfera pública. Sobre la base de estas caracterizaciones, se comparan las visiones de estos autores y se analizan las diferencias en su conceptualización de la experticia. Se argumenta que las diferencias de estos dos modelos en relación con el estatus ontológico del mundo de la vida marcan sus visiones de la experticia y los debates actuales acerca de sus posibilidades de convertibilidad en la literatura especializada. El artículo finaliza con un resumen y posibles líneas futuras de investigación.: This article seeks to observe the differences between the functional-systemic model and the pragmatic-formal model in their understanding of scientific expertise and its role in modern societies. First, a brief diagnosis about the importance of trust in scientific expertise in contemporary society and how this process has been analyzed in the specialized literature will be made. Then, the description of scientific knowledge will be analyzed from the point of view of the functional systemic model. Using the concepts of functional differentiation and structural coupling, it will be argued that scientific knowledge is here considered a specialized form of communication characteristic of a functional system. Next, the approximation of the formal-pragmatic model is described. Of special importance here are the ideas of lifeworld and public sphere. On the basis of these characterizations, the visions of these authors are compared and the differences are analyzed in relation to their conceptualization of expertise. It is then suggested that the differences between these two models in relation to the ontological status of the lifeworld shape their views of scientific expertise as well as current debates on this topic. Este texto plantea la posibilidad de realizar una aproximación entre la angustia heideggeriana y la angustia lacaniana. De este modo, se comprueba cómo ambos autores comprenden la angustia como el estado esencial y propio del hombre. Tanto Heidegger como Lacan presentan la angustia como el estado en el que lo imposible, lo que no puede ser representado como objeto, se manifiesta en su esencia. Así, ambos señalan que el objeto de la angustia es la condición para la aparición de cualquier (...) objeto, es decir, plantean la angustia y aquello que ella presenta como la manifestación de lo real mismo. No obstante, es precisamente desde la angustia donde podemos apreciar la diferencia notable que existe entre ambos autores. (shrink)

Studies demonstrating the benefits of ethical behavior at an individual level are scarce. The business ethics literature centers its analysis on unethical behaviors and their consequences, rather than ethical behaviors and their benefits. There is now considerable debate on the role of auditors in society and the function of accounting firms in the free market capitalist system. Specifically, the eminently ethical nature of the auditor’s work has been highlighted. Therefore, the aim of our paper is to show the impact of (...) auditors’ sustained ethical behavior: the trust it generates. This trust results in considerable benefits for the firm due to a reduction in the costs of the partner’s supervision of the auditor. The methodology chosen to validate these claims is a survey of partner of the audit firm in auditing companies. The results of this research confirm the hypotheses raised in the theoretical model. María Zambrano reflexiona sobre algunas preocupaciones que siempre le han interesado: el cristianismo y la mística, las procesiones o misiones divinas, la encarnación de Cristo, la Virgen, la liturgia, entre otras vivencias personales. Se descubre en su pensamiento de modo sobresaliente la búsqueda del Espíritu como fundamento del conocimiento, por lo que se podría llegar a decir que esta vivencia contribuye y da pie al rechazo del racionalismo y del materialismo en su concepción de la filosofía.

Resumen: Esta exposición intenta comprender las formas culturales de comunicación y fijación mnémica en una narración específica que Davi Kopenawa, chamán Yanomami, expone al antropólogo Bruce Albert, en virtud de los modos de existencia amazónicos, refiriéndose en particular a la intensidad de los espíritus selváticos y a la experiencia chamánica con los mundos espirituales. En el contexto de una extensión vegetal dispersa y sobresaliente, afirmamos una sociabilidad cotidiana en el marco de una “ética respetuosa o amorosa” entre todas las formas (...) de vida, expresada estéticamente en formas significantes y transportadoras de emociones desarrolladas por la cosmología amazónica. Para ello utilizamos las nociones que Aby Warburg emplea en su estudio de la cultura de las imágenes, en tanto curso por el que estas pueden entenderse como organismos vivientes susceptibles a transformación, preservando su propia biología en la trasmisión codificada de la memoria.: This exhibition tries to understand the cultural forms of communication and mnemic fixation in a specific narrative that Davi Kopenawa, Yanomami shaman, exposes to the anthropologist Bruce Albert, by virtue of Amazonian modes of existence, especially referring to the intensity of jungle spirits and experience Shamanic with spiritual worlds. In the context of a dispersed and outstanding plant extension, we affirm a daily sociability within the framework of a “respectful or loving ethic” among all life forms, aesthetically expressed in significant and transporting forms of emotions developed by Amazonian cosmology. For this we use the notions that Aby Warburg uses in his study of the culture of images, as a course by which they can be understood as living organisms susceptible to transformation, preserving their own biology in the coded transmission of memory. This study proposes and tests a model that integrates culture, attitudes, subjective norms, and attributions into a theoretical framework that explains tolerance toward nepotism in a Latin American country. The participants were 202 Ecuadorian middle and upper managers. The results suggested that attitudes, subjective norms, and attributions significantly predict managerial intention to discipline those employees who favored a family member when hiring. Furthermore, subjective norms and internal attributions mediated the relationship between culture and intentions to discipline employees who engaged in (...) nepotistic acts. Our findings highlight the need to implement culture-congruent HR practices to effect mission-driven changes in talent management practices. (shrink)
